1. Acceptance
By creating an account or using MyPotential ("the app", "the service"), you agree to these Terms of Service, which also serve as the end-user licence agreement for the app. If you do not agree, do not use the app. These terms form a binding agreement between you and the operator of MyPotential (based in the Netherlands) - not with Apple (see section 15).
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use MyPotential on devices you own or control, for your own personal, non-commercial use. On iOS, that licence is limited by the Usage Rules in Apple's App Store Terms of Service, including the rule that lets members of your Family Sharing group use the app. We keep all rights not expressly granted to you.
3. Who can use MyPotential
You must be at least 16 years old to create an account. By using the app you confirm you meet this requirement. If you are under 18, you confirm you have your parent or guardian's permission. You may not use MyPotential if you are barred from doing so under the laws of your country, and by using it you confirm you are not located in a country subject to a U.S. embargo or listed on a U.S. prohibited-party list - a confirmation Apple requires of every App Store app.
4. Your account
- You are responsible for keeping your login credentials secure.
- You are responsible for all activity that happens under your account.
- You may only create one account per person. Do not share accounts.
- Notify us immediately at mypotential.contact@gmail.com if you believe your account has been compromised.
5. Acceptable use
You agree not to:
- Use the app for any unlawful purpose or in violation of any applicable law.
- Attempt to reverse-engineer, decompile, scrape, or extract data from the service, except to the extent that applicable law expressly permits it.
- Abuse, overload, or interfere with the app's infrastructure, or circumvent any rate limit or security measure.
- Use the AI features to generate harmful, abusive, or misleading content, or content that infringes anyone's rights.
- Upload a photo you do not have the right to use, or one containing another person's personal information.
- Attempt to access another user's data or account.
- Rent, resell, sublicense, or redistribute the app or its output as your own service.
We may suspend or terminate accounts that breach these rules. If you believe content in the app infringes your rights, email us and we will act on it promptly.
6. AI features - important limitations
MyPotential includes AI-powered features: the Luna coach, Daily Brief, Weekly Review, and meal suggestions. These are provided for informational and motivational purposes only.
- AI responses are generated automatically and may contain errors or inaccuracies.
- They are not a substitute for professional medical, nutritional, psychiatric, or fitness advice.
- Do not make significant health or medical decisions based solely on AI-generated content.
- Calorie, macro, and hydration targets are estimates based on standard formulas - they may not be accurate for your individual circumstances.
- You can speak to Luna instead of typing. Speech is converted to text by your device's own operating system and may be transcribed incorrectly - check that Luna understood you before acting on the reply.
- Food, receipt and gym-equipment scanning reads a photo and guesses at its contents. Always check the result before relying on it, particularly if you have an allergy or a medical condition.
- MyPotential does not diagnose, treat, cure, or prevent any disease, and is not a medical device.
7. Your data and your content
You choose to enter health and wellbeing data (weight, calories, sleep, medications, faith and habit entries, and so on), and you may choose to scan photos of meals or receipts. You do this voluntarily. You retain ownership of everything you enter; we claim no rights over it beyond the permission needed to store it, sync it, and run the features you ask for. We handle it as described in our Privacy Policy, and you can export or permanently delete it at any time from Settings.
8. Third-party integrations and bank connections
MyPotential can connect to third-party services such as WHOOP, Oura, Fitbit, Garmin, Apple Health, Google, and - in the Finance section - a bank account through GoCardless, a regulated open-banking provider. Your use of those services is governed by their own terms, and you can disconnect any of them at any time in Settings.
Bank access is read-only: the app can display balances and transactions but cannot move, send, or spend money. MyPotential is not a bank, a payment service, or a financial adviser, and nothing in the app is investment, tax, or financial advice. We are not responsible for the availability, accuracy, or actions of any third-party service.
9. Subscriptions, trials and payment
MyPotential is a subscription app. You can use parts of it for free, and full access requires a paid subscription. Everything below applies from the moment you subscribe, and the purchase screen always shows you the terms before you confirm.
- Plans and prices. MyPotential Premium is offered as an auto-renewable subscription, monthly or yearly. The reference prices are €14.99 per month and €64.99 per year; the price you actually pay is set by Apple for your country's App Store, is shown in your own currency and includes any applicable VAT. The plan's name, its length and its price are always displayed on the purchase screen before you confirm. Each plan is billed at the start of its period.
- Purchases on iOS. Subscriptions bought in the iOS app are auto-renewable in-app purchases processed by Apple and charged to your Apple Account at confirmation of purchase. We never see or store your card details.
- Free trials. A trial is free for the stated number of days. If you do not cancel it at least 24 hours before it ends, it converts automatically into a paid subscription and the first payment is taken then. Any unused part of a free trial is forfeited if you buy a subscription during the trial.
- Automatic renewal. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends, at the then-current price. We will give advance notice of any price change and you may cancel before it takes effect.
- Managing and cancelling. On iOS, manage or cancel your subscription in your device's Settings → your name → Subscriptions, at any time after purchase; the current period cannot be cancelled mid-term. Elsewhere, cancel in Settings inside the app. Cancellation stops the next renewal and you keep access until the end of the period you have paid for. We do not delete your data when a subscription ends.
- Refunds. Purchases made through Apple are refunded by Apple under its own policy - request one at reportaproblem.apple.com. We cannot issue refunds for Apple purchases. For any purchase made directly from us, payments already made are non-refundable except where the law requires otherwise or where we have failed to provide the service; contact us and we will deal with it fairly.
- EU right of withdrawal. As a consumer in the EU you have 14 days to withdraw from a purchase. Because MyPotential is digital content supplied immediately, by subscribing you ask us to start the service at once and acknowledge that you lose that right once it has been fully performed. This does not affect the statutory rights you keep in any case.
MyPotential shows no advertising and does not sell your data.
10. Availability and changes
We aim to keep MyPotential available at all times but do not guarantee uninterrupted service. We may change, suspend, or discontinue features at any time. We will try to give reasonable notice of significant changes, and if we discontinue the service you will be able to export your data first.
We may update these terms. We will indicate the revision date at the top of this page and notify you in the app of any material change. Continued use after a change constitutes acceptance of the updated terms; if you do not accept them, stop using the app and delete your account.
11. Intellectual property
The MyPotential name, logo, design, and software are owned by or licensed to us. You may not copy, reproduce, or redistribute any part of the app without our written permission. Your personal data belongs to you - we do not claim ownership of it.
12. Disclaimer and limitation of liability
To the fullest extent permitted by law:
- MyPotential is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the app.
- We are not liable for decisions you make based on information or AI output in the app.
- Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months prior to the claim (which may be zero for free-tier users).
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be excluded under applicable EU or local consumer law. If your jurisdiction does not allow some of these exclusions, they simply do not apply to you.
13. Termination
You can delete your account at any time from Settings → Delete account. We may suspend or terminate your account if you violate these terms. Upon termination your data will be deleted in accordance with our Privacy Policy.
14. Governing law
These terms are governed by the laws of the Netherlands. Any disputes shall be subject to the jurisdiction of the Dutch courts, without prejudice to your rights as a consumer under EU law or the mandatory law of your country of residence.
15. Terms that apply to the iOS app
If you obtained MyPotential from the Apple App Store, the following also applies, and prevails over anything inconsistent above:
- This agreement is between you and us only, not with Apple. Apple is not responsible for MyPotential or its content.
- Apple has no obligation to provide any maintenance or support for MyPotential. Support questions go to mypotential.contact@gmail.com.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the app - including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or privacy law.
- We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that the app infringes that party's intellectual property rights.
- Your use of the app must comply with the Usage Rules in Apple's App Store Terms of Service.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.
